The subject of registration
of commercial trademarks and
data is governed by Act No.
21 for year 1957 “Commercial
Trademarks and Data”, which
was last amended by CPA
Order No. 80 published in
the Al-Waqai Al- Iraqiya
(official gazette) No. 3983
on June 2004 (an amendment
which has not been
implemented yet).
The procedure for
registering commercial
trademarks is as
follows:
1- Submittal of a color
image of the trademark
for the purpose of
preliminary inspection.
2- Payment of dues for
the preliminary
inspection and
preliminary
registration.
3- If a similar
trademark is not found
upon conducting the
preliminary inspection,
the registration shall
be published in the
special bulletin and
payment of dues thereof.
4- Subsequent to the
payment of the final
acceptance dues, the
commercial trademark
registration certificate
will issued.
The total dues to be
paid by an Arab or
foreign COMPANY for
completion of the
aforementioned procedure
is not in excess of
(1500 $) one thousand
five hundred US dollars.
Required Prerequisites By
For Completion Of
Registration:
1- A color image of the
commercial trademark.
2- A power of attorney
in the name of the
person undertaking the
registration (including
the full name of the
lawyer) issued by the
principal COMPANY (a
power of attorney issued
by the COMPANY’s
representative in Iraq
or one of its branches
is not permitted) and
signed by the COMPANY’s
managing director or an
authorized person. This
power of attorney must
be authenticated by the
Public Notary, the
principal COMPANY’s
Foreign Ministry and the
Iraqi Embassy in the
principle COMPANY'S
country. If there is no
Iraqi embassy in that
country, the embassy in
the nearest country to
that of the principal
COMPANY will suffice.
3- The duration for the
completion of the
registration process
shall not exceed 60
days.

300 000 dinars

application, with the
addition of the
following dues according
to category, as follows
:
50 000 dinars dues for
categories 1 to 3
30 000 dinars for
category 4
20 000 dinars for
category 5 and above.
